This is the big question a lot of Americans are having with the decision of having trials for terrorists in United States Court. Lindsey Graham you really hit the nail on the head when he was questioning Erik Holder(Attorney General). This is the type of leadership we are looking for in the Republican party. It’s about time someone gets a backbone. There are things going on that is so far from our just country. It sickens me that this is happening in our country, but if leaders like yourself Mr. Graham stand up and take the bull by the horns and fight to keep the honesty in our Government. We need this today and we need it from the Republican party.

I think the people of Virginia have spoken this election. This is not the time to relax, we the conservatives need to step up the campaign and keep the pressure on the left. This is more than just wantinglower taxes, this is about the direction we are moving as a country. This is so much more than just state politics. We are moving far left as a nation and fast. Now the officials elected in Virginia need to Govern as conservatives and know why they were elected and not lose sight of there conservative values. This is a good day for Virginia and America. Fox News under attack again byRahm Emanuel, speaker of the houseand(open the Glenn Beck link in this window). “Question with Boldness” famous by Glenn Beck. What will happen if Fox keeps producing the “news” while gaining more and more support? Will they get the plug pulled on them or will they prevail and overcome this push to quite them? Well they do have a large support throughout the country which is from all political backgrounds. So Congress will have to pass a law to quite them along with any station that counters the policies of this administration. Will this not go against our Constitution. What then will this country do if media and news is controlled by Government? Anita Dunnspoke at a high school graduation the other day and spoke very controversial to these young minds. She talked about how Mao Tse-Tung and Mother Teresa were two people she admire in the world. Mother Teresa I have no problem and don’t think anyone would. But Mao Tse-Tung is responsible for killing millions of people, well more than Hitler ever killed. I got sick reading about Mao Tse-Tung but needs to be studied so we know what we are up against. There are many people in our country who believe in this theology. It is dangerous, irresponsible and un-American. I don’t know what else to say. We need to turn it around. What is this, when does Government go after news stations for there content. Or should I say the Fox News Station. Did President Bush not get slamed by just about every station on tv during his Presidency. At least we can say he didn’t flip flop, from one day to the next. These clips look doctored to make him look stupid. Now Fox better not show a clip of this Administration in its entirety or it is said to be ”untrue”. When did he ever put the iron fist down or send his people out to discredit that particular station or stations. Fox news has been on the air for 15 years and has been growing faster than any other station on TV. Fox is viewed by many from the Right, Left and Center. There is no requirement or party affiliation with Fox. They have Liberal commentators, Conservative commentators and Middle of the road. Their news is not biased although their commentary may be, but there is a voice from all sides. That has been my experience for the last 7 years of watching. There isShawn Hannity (conservative), Bill Oriely (Libertarian), Glenn Beck (Libertarian), Britt Hume ( Liberal), Geraldo (Liberal), and a vast of guests from all political backgrounds. To me, it seems hard to peg Fox News as a Conservative Right Wing news station. And if they were, what business is it of the Government. I was suggested the other daythat Fox is more into research. Hello! News is research and unless the station does their research maybe that station shouldn’t be broadcasting. That’s one of the main problems with media today. They say whatever they want when they whant and without substantial proof. President Bush was the most ridiculed president by the press since I can remember. He continued to take care of the issues that involved the Nation regardless if you agreed or disagreed with his choices. We have moved into dark time in this country. People are speaking out in large numbers but are being ignored. These are tax paying citizens which many have not partaken in protests before. We must not tire, but get more involved and dedicated and gather with like minded people such as the Tea Parties. We also need to help those who may not understand even those who are just lost. Get educated on the candidates and their history, and vote. This is the best hope our country has and will suffer a great loss if we do not. Have you noticed all the tax increases take affect 2013. The year after the second term election. Hmmmmmmm……. Lastly, Fox is well rounded with views from all sides, while one is not more presented than the other. Hannity, Beck, Geraldo are opinion and not the news. While other stations go out of there way to defam law biding citizens. Today when I woke up one of the first things I heard when I turned on Fox News was, the President was named the winner of the Nobel Peace Prize. I do believe he was in office for a total of 11 days when he was picked as the winner says Rush Limbaugh. Some of the winners in the past were Presidents Wilson, Roosevelt, Carter, Vice President Gore. All left wing agenda politicians. President Reagan didn’t win. He had the longest peace period of any U.S president. Could it be, it takes a Progressive to know one. What rode is our country headed down, because it’s not the road of freedom and prosperity. Our troops are in harms way, the dollar is falling, unemployment is 9.8% and liberals are amazed at the good work by our President. How much longer can this administration ride the coat tails of President Bush. We as a country are in trouble and Idon’t even want to think about it. I’m affraid we are all going to find out. What happens when the intrest rates skyrocket from all the money we are printing. What happens if the Arab nations decide to no longer use U.S currency. Something to think about and think about it hard. President Reagan by far did more for our Nation and Nations around the world than any President of the United States. He kept us leading the world, produced jobs, and brought down the Soviet Union. This Nobel Peace Prize should be called the Nobel Appeasement Prize. We have so much more to be thinking about and not be distracted by outside nations. We better start turning this country around and we know how to do it, but I’m afraid this is intentional. Everyone pray, get on your nees any pray, pray, pray. Until next time, keep the faith and always know who is in charge. The Government and the media, are in bed together. Nothing new as we all know. Out right lies, lies to your face whenever their lips are moving. Speaker of the House Pelosi stated there is a Value Added Tax on the table. We hear people can’t afford health care so lets implement a value added tax. What in the world, why would we want to add taxes in an economy that is hurting, people are out of work for the love of life. ”If you make less than $250,000.00 a year your taxes will not go up“. What is this, a value added tax. So lets see, you buy a product and you pay State sales tax. I’m ok with that, but now, if this Value Added Tax passes then you will have to pay another tax on top of the State sales tax. Tell me, how is that going to help our economy. How is that going to put people back to work. This is scary people, none of this is because of ignorance, it is a well thought out and planned attack against Capitalism. Let me ask you this qustion and ask yourself. Are your taxes decreasing or do you feel they are on the brink of going up? By the way, under President bush apporximately 40% of Americans didn’t pay income tax. I was not pleased when Congressman Grayson made outrageous comment today on the floor of the House today. He said “If you get sick, America, the Republican health care plan is this: Die quickly. That’s right. The Republicans want you to die quickly if you get sick”. I’m a Conservative and I don’t want anyone to die. Are politics have gone out the window. What is the Congressman thinking about. It sounds like another ploy to conjure up support for a Health care bill that overwhelming Americans do not want. It sounds like liberals are hateful people who pout when they can’t pull the wool over the eye’s of the American people. Lets blame Conservatives, lets blame the American people and lets call them names and try to degrade them. The Blame America Crowd. I don’t get it, We the People are the boss, are we not? Our politicians are out of hand and it seems they have forgotten the reason to get into public service. It’s not for money, clout, power although they are all linked, it’s to serve the people of this great Nation. Let get rid of the career politician and if we are going to cap salaries of CEO’s, lets cap the salary of Congress. In fact they should have a huge cut in pay because of their approval rating is so low. Get off the high horse people and start doing what you where sent to Washington to do. There is so much waste of money and time with personal self indulgent behavior. We the voters need to get educated and begin to vote these people out of office. There is no Democratic Republic any longer. Do you feel you are being represented. Look at us throughout the world. How many apologies have been made for our country? Why is America blamed for poor nations? Hatred, hatred for this country by the hard left. It has to stop. Vote these people out.

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.
What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and maybe forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business and put everyone into a government-run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.
However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go=2 0will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access by the appointees of the Obama administration (and all those that come hereafter) of all of your personal healthcare information, your personal financial information, and the information re: your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures. You can forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance or if you have private insurance that is not deemed “acceptable” to the “Health Choices Administrator” appointed by Obama there will be a tax imposed on you. It is called a “tax” instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work - because, since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the “due process of law.
So, there are three of those pesky amendments that the far left hate so much out of the original ten in the Bill of Rights that are effectively nullified by this law. It doesn’t stop there, though:
The 9th Amendment that provides: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;”
The 10th Amendment that states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people.”
Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control. I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights.
Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation” to support the Constitution. If I were a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation.
If I voted for it anyway I would hope the American people would hold me accountable.

* MORE ABOUT THE HEALTH CARE BILLS *
How many times have we watched a movie about World War II and looked at the scene where a menacing Nazi soldier has stopped a citizen of an occupied country or even a German citizen and demanded to see the person’s “identity papers.” Failure to produce such papers would cause the person to be immediately arrested. I always felt good when I watched this because I knew that in my free country that couldn’t happen.
Yes, we have our driver’s license that you have to produce if you are stopped for a driving infraction and you may have to produce to write a check. However, if you choose not to drive you are not required to have one and you can get another form of identification to do something like cash a check. Yet, the fact is that you are not legally required to have either of these documents and if you do have them they can only contain a limited amount of information.
When I was practicing law I dealt with a situation where, in the State of Louisiana , you were required to provide your Social Security number to get a Driver’s License and it was also put on the license for everyone to see. I represented a client who had both privacy objections to this and religious objections. We won the case on the grounds that this requirement violated his constitutional rights. What made this particularly interesting was the fact that in support of our position I cited an opinion by a Court of Appeal Justice named Ruth Bader Ginsburg who is now one of the more liberal members of the Supreme Court.
Now, HB 3200 will mandate that everyone in the United States ha ve a National Healthcare card that they will be required to produce to get medical treatment. This will be required whether they have private health insurance or are involved in the so-called public option. There are no real options, you must have this card and it can contain any information that the Obama administration requires. It will be the “identity papers” that so many totalitarian regimes are infamous for.
Of course, you may be thinking that this will no longer be a problem if the “public option” is removed from the bill. This has been a trial balloon floated by the Obama administration yet it really means nothing if the rest of the bill is adopted. The Congress will still be transferring unlimited power to the Executive Branch of Government and the Commissioner appointed by President Obama can still require a National Health Care identification card, still have access to your financial and medical records, and still fine you for having a plan unacceptable to the government. This will result in the ultimate destruction of private health insurance and the adoption of a public system of rationed health care totally controlled by the government.
I found it interesting that a week after I wrote my first blog qu estioning the constitutionality of House Bill 3200 Judge Andrew Napolitano on Fox News interviewed two Constitutional experts who also saw this as an unconstitutional action by the Congress. They pointed out that normally when this type of legislation is introduced in Congress the members of the House of Representatives or the Senate cite the provisions of the U.S. Constitution that authorize such legislation. This has not been the case in any of the Health Care Bills proposed.
This is not a simple oversight on the part of the Congress. They know they don’t have Constitutional authority to do this, but they simply don’t care. They intend to do it anyway. I find this to be both supremely arrogant, and absolutely terrifying.
If they succeed in this, then no provisions of the Constitution are safe from attack.
In fact, in future articles I will point out where other provisions of our Constitution that I consider sacred are being totally disregarded and under full scale assault by the Congress and the Obama administration. I repeat what I said in my previous article; this is not about health care. It is about our fundamental rights as free citizens of the United States .

Today in Brunswick a man was arrested for not having a permit. Looking at the video, the gentleman who is a Minister was defiant at first with police but then cooperate with police. Agree or not with this man, he is passionate with todays issues and this issue on health care. Both sides are passionate and I for one don’t want to see people who are outraged over this health care bill misrepresented in the press. I may be asking a lot. The protest are getting larger and more pronounced. There is a march on Washington September 12th. We should see many people come together with like concerns. Glenn Beck will be covering this story and if you are serious about stopping this bill then he is someone you want to watch. Once again thank you for your visit and until next time.
